I Was Hit By a Car on My Bicycle in Louisville, Kentucky. What Should I Do?

You didn’t expect your ride to end like this. One moment you’re moving through a familiar street or a designated bike lane, and the next, you’re on the ground trying to process what just happened. If you’re searching online for “I was hit by a car on my bicycle” and looking for answers, this is a good place to start.

In Louisville, bicycle accidents happen more often than people realize. May is Bicycle Safety Month, which brings more visibility to cyclists, but it also highlights a hard truth: even when you follow traffic laws, you’re still vulnerable around motor vehicles. The drivers who share the road with you aren’t always paying attention.

You may already be dealing with pain, confusion, or calls from insurance companies. Before anything else, focus on what actually protects you right now: your health, your rights, and your ability to recover compensation.

At a Glance

• Bicycles are considered vehicles under Kentucky law, giving cyclists the same road rights as drivers.
• Kentucky is a no-fault state and PIP may provide up to $10,000 for medical expenses and lost wages after a bicycle accident.
• Drivers are legally required to allow at least three feet when passing a cyclist.
• You can still recover compensation even if you were partially responsible for the accident.
• The statute of limitations in Kentucky is generally two years from the date of the accident or last PIP payment.
• Insurance adjusters often contact injured cyclists quickly. Before you respond, contact a Louisville bicycle accident lawyer.
• A police report, photos, and medical records are the foundation of a strong bicycle accident claim.

What Happened After the Crash and What to Do Now

If you called 911 and waited for the police, you already did one of the most important things. A police report creates an official record of the accident: who was involved, what the scene looked like, and what local authorities observed. That document follows your bicycle accident case from the beginning.

If you were able to gather evidence at the scene, including photos of the bike lane or roadway, skid marks, vehicle damage, and traffic signals, that carries more weight than what gets pieced together later.

A few things may still be in front of you right now that directly affect your claim:

• The at-fault driver’s insurance company may have already contacted you
• You may be wondering whether to give a recorded statement or accept an early offer
• You may be unsure whether your injuries are serious enough to pursue a claim

None of those decisions should be made before you speak with a Louisville, KY bicycle accident lawyer. Insurance adjusters move quickly after a bicycle crash, often before injured cyclists understand the full extent of their injuries or their rights under Kentucky law.

When to Seek Medical Attention, Even If You Feel Fine

Adrenaline can mask pain, and some of the most serious conditions after a bike accident don’t show up right away. Head injuries, internal bleeding, and soft tissue damage can all develop or worsen in the hours and days after the accident.

Seek medical attention if you notice any of the following:

• Headaches, dizziness, or confusion
• Bruising that worsens over time
• Pain that increases rather than improves
• Limited movement or stiffness
• Visible injuries that appear after leaving the accident scene

Medical records do more than track your recovery. They become important evidence in your personal injury claim. Delaying care gives insurance companies a reason to question whether your injuries were serious or whether they came from the accident at all.

What Kentucky Law Says About Cyclists on the Road

Kentucky bicycle accident laws draw from multiple sources. In Louisville, the operation of a bicycle is governed by the Kentucky Revised Statutes, the Kentucky Administrative Regulations of the Transportation Cabinet, and the Ordinances of Louisville-Jefferson County Metro Government.

Under Louisville Metro bike laws, bicycles are considered vehicles, which means cyclists have the same rights and responsibilities as motor vehicle drivers on public roadways. Whether you were riding a traditional road bike or an e-bike, your rights to the road remain protected under Kentucky law.

For motorists, that comes with specific obligations toward cyclists:

• Drivers must share the road with cyclists
• Before passing, a driver must pass only when able to allow at least three feet between their vehicle and the cyclist, measured from the extent of their rearview mirrors
• Drivers must return to their lane only when completely clear of the cyclist
• If turning right after passing a cyclist, drivers must leave enough room so the cyclist’s path is not obstructed

When a driver fails to follow these rules and a bicycle accident occurs, that failure becomes central to determining liability in your claim.

How Kentucky Insurance and Tort Law Affects Your Claim

Beyond the rules of the road, Kentucky’s insurance and tort laws directly shape what happens after a bicycle accident. Under Kentucky’s Motor Vehicle Reparations Act (KRS 304.39), the state operates as a no-fault insurance state.

Personal injury protection (PIP) provides up to $10,000 per person for medical expenses and lost wages.  If you were struck by a car while riding your bicycle, PIP benefits generally begin with the auto insurance policy covering the vehicle that hit you.

If that coverage is unavailable, other sources such as your own auto policy, a household policy, or the Kentucky Assigned Claims Plan may apply. In Kentucky, the statute of limitations is generally two years, but the deadline may run from the date of the accident or the last PIP payment, depending on the circumstances. This is one more reason to contact an attorney sooner rather than later.

Kentucky law also places thresholds on when an injured cyclist can file a personal injury lawsuit against the at-fault driver. Your injuries must meet at least one of the following:

• $1,000 or more in medical expenses
• A broken bone
• Permanent disfigurement
• Permanent injury
• Death

Meeting one of these thresholds allows you to step outside Kentucky’s no-fault system and pursue a personal injury claim directly against the at-fault driver.

Kentucky’s pure comparative fault rule also means you can still recover compensation even if you were partially responsible for the accident. Your recovery is reduced by your percentage of fault, not eliminated.

Who Is at Fault in a Kentucky Bicycle Accident?

Determining liability in bicycle collisions isn’t always straightforward. Driver error is the most common factor, but road conditions, visibility, and the actions of both involved parties all play a role.

Common causes of Kentucky bicycle accidents include:

• A driver fails to yield the right of way
• Unsafe passing in a single lane
• Distracted driving
• Failure to check for cyclists before turning
• Ignoring designated bike lanes

Even when fault seems obvious, insurance companies will look for ways to reduce what they owe. Having a Louisville personal injury lawyer involved early means someone is protecting the critical evidence and your account of what happened before those details fade or disappear.

How Insurance Works After a Bicycle Accident

Insurance is where things often get complicated after a bicycle accident, and where injured cyclists are most likely to make costly mistakes on their own.

After a bike accident involving motor vehicles, multiple coverage types may apply, including PIP benefits, liability coverage from the at-fault driver, and uninsured motorist coverage if the driver doesn’t carry adequate insurance. Insurance adjusters often contact injured cyclists quickly, sometimes within days of the accident, asking for recorded statements or offering early settlements.

Before agreeing to anything, keep these points in mind:

• Early settlement offers rarely reflect the full cost of long-term medical care or lost income
• Recorded statements can be used to shift blame or reduce your claim
• The full extent of injuries is often not immediately apparent, particularly in cases involving head injuries

This is one of the clearest reasons to reach out to bicycle accident lawyers before you respond to any insurer. Legal help at this stage isn’t about filing a lawsuit. It’s about making sure you don’t give up rights you didn’t know you had.

What Compensation May Be Available to You

A bicycle accident can affect far more than your immediate medical bills. Depending on your situation, you may be able to recover compensation for:

• Medical expenses, including ongoing medical care and physical therapy
• Lost wages and lost income if you missed work during recovery
• Property damage to your bicycle and gear
• Non-economic damages such as pain and suffering
• Permanent disability in cases involving severe injuries

Each bicycle accident case is different. The goal is fair compensation that reflects what you’re actually dealing with, not just what an insurance company decides to offer before you’ve spoken with anyone.

Bicycle Safety Month and What It Means for Louisville Cyclists

May is Bicycle Safety Month, recognized by the National Highway Traffic Safety Administration, which draws attention to how often these accidents happen and how many are preventable. In Louisville, that means increased use of bike lanes and shared roadways, more cyclists riding alongside motor vehicle drivers, and renewed conversations about traffic laws, helmet laws, and helmet use.

Even with awareness campaigns, bicycle crashes still happen, often because drivers fail to give cyclists enough space or fail to recognize their presence altogether. Knowing your legal options after such incidents counts for just as much as knowing how to ride safely.

Frequently Asked Questions

What to do after a bicycle accident in Louisville?

Call 911, request medical help, and wait for police to document the scene. Gather evidence if you’re able (e.g., photos of the roadway, vehicle damage, skid marks, and traffic signals.) Get the driver’s insurance information and witness contacts. Avoid discussing fault at the scene, and contact a Louisville bicycle accident lawyer before speaking with any insurance company.

Do I need a police report after a bicycle accident?

Yes. Kentucky law requires reporting any crash that causes injury, death, or property damage over $500. A police report documents who was involved, what citations were issued, and how the accident occurred, all of which support your personal injury claim.

What if I was partially responsible for the accident?

You may still recover compensation under Kentucky law. Your recovery is reduced based on your percentage of fault, not eliminated.

What if the driver doesn’t have insurance?

If the at-fault driver is uninsured, PIP benefits and other compensation may be available through your own auto insurance policy, a household member’s policy, or the Kentucky Assigned Claims Plan. A Louisville personal injury lawyer can review your coverage and identify the options available to you.

Do helmet laws affect my claim?

Kentucky doesn’t require helmets for adult cyclists under state law, so not wearing one doesn’t automatically bar you from recovering compensation. However, insurance companies may raise it. An attorney can address that argument directly.
